Terms of Service

These terms govern your use of Picturental Ltd's marketplace at picturental.com (the "Service"). By creating an account, listing gear, or booking a rental, you agree to be bound by them.

1. What Picturental is

Picturental is a peer-to-peer rental marketplace for film and photo gear. We connect renters with owners but we are not party to any rental contract — that's between the renter and the owner. We do provide payment processing, ID verification, dispute mediation, and Picturental Protect damage cover as part of the platform fee.

2. Who can use it

You must be 18 or older, legally able to enter a contract in your jurisdiction, and complete ID verification before listing or booking. We reserve the right to refuse service for any reason at our discretion.

3. Listings

Owners are responsible for accurately describing their gear, setting fair prices, honouring confirmed bookings, and complying with any applicable rental, tax, or insurance regulations in their jurisdiction.

4. Payments + payouts

Renters pay through Stripe Checkout at the time the owner approves a booking. Funds are held in escrow until the rental ends. Picturental keeps a 12% platform fee (minimum £1/day) which covers Picturental Protect, secure payments, and dispute support. The remaining 88% is paid out to the owner's linked Stripe Express account, typically within 24 hours of the rental being marked complete.

5. Picturental Protect

Every booking includes basic damage cover, subject to terms, exclusions, and excesses to be published in full prior to live launch. High-value items may require additional deposit at the owner's discretion. Picturental Protect does not cover loss outside the owner's reasonable expectations, willful damage, or rentals that breach our acceptable-use rules.

6. Cancellations + disputes

Renters may cancel pending requests before the owner approves them. Once approved and paid, cancellations are subject to Picturental's cancellation policy (to be published). Disputes are mediated by Picturental's support team in good faith using booking metadata, message history, and any evidence provided by both parties.

7. Prohibited conduct

  • Renting or listing stolen, counterfeit, or illegally-acquired gear
  • Circumventing the payment system (e.g. agreeing to pay offline)
  • Harassment, threats, or discriminatory behaviour
  • Attempting to compromise the Service or scrape user data

8. Account termination

We may suspend or terminate accounts that violate these terms or endanger other users. Outstanding bookings will be honoured or refunded at Picturental's discretion.

9. Liability

Picturental's liability is limited to the amount of fees paid by you in the 12 months preceding any claim. We are not liable for the condition, performance, or fitness for purpose of any gear listed by third-party owners.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
